Is your Halloween costume violating a copyright or trademark? Most likely no. Even if you make your own costume, most fan creations would fall under the protections of fair use. But if these unlicensed costumes enter the marketplace, the issues becomes much more complex. This presents an interesting dilemma when a particular costume may not be sustainable in the marketplace.
